A trust is an arrangement whereby trust property is held by one person, namely the trustee, on behalf of and for the benefit of another person, namely the beneficiary.

Trusts can be created in terms of a will, when a testator (a person making a will) bequeaths property in their will to a trustee, to be held and administrated in favour of nominated beneficiaries. In this instance, the trust only comes into operation on the death of the testator and is known as a testamentary trust. Trusts can also be created during the lifetime of the founder of the trust in terms of a trust deed, whereby the founder transfers property to the trustee to be administered in favour of nominated beneficiaries. This is known as an inter vivos trust.
