What is an Uncontested Divorce?
A divorcing couple can get divorced on an unopposed basis when they are able to agree on all the major issues involved in the dissolution of their marriage, such as the division of immovable and movable property, care and contact and maintenance in respect of their children, and spousal maintenance.
In an unopposed divorce, both parties can jointly appoint and consult with an attorney who will assist with drafting the Settlement Agreement and Parenting Plan, if applicable, and submit these documents to the court for approval. There is no need for a formal trial and only the Plaintiff needs to appear in court for a brief period on the divorce hearing date, in order for the court to grant a Decree of Divorce.
